Terms of Service

1. Acceptance of Terms

By accessing and using ScanToBIM-CAD ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ScanToBIM-CAD is a software-as-a-service platform that converts 3D point cloud scans (E57, LAS, LAZ and PLY files) into 2D CAD floor plans (DXF) and 3D BIM models (IFC and Revit RVT). The service is provided through a web-based interface and automated processing backend.

3. User Accounts

To use our service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Upload malicious files or content that could harm our systems
• Attempt to reverse engineer, decompile, or disassemble our software
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers connected to the Service
• Upload files that infringe on third-party intellectual property rights

5. Point Cloud Data & The Dual Guarantee

When uploading 3D laser scans and point cloud data to the Service, the relationship is governed by our Dual Guarantee:

• Confidentiality and anonymized examples: Raw laser scans, point clouds and the CAD/BIM models derived from them remain the customer's property. We never sell them, and we never publish them in a form that identifies you. We may use derived results (floor plans, 3D models, images and accuracy figures) in our marketing, such as our website, case studies, social media and presentations, only after anonymizing them: we remove names, addresses, logos, people and anything else that identifies the customer, the building or its location. Publishing anything that identifies you or your building requires your prior written consent. You can ask us at any time to stop using an anonymized example by writing to privacy@thescantobim.com, and we will remove it from our own channels within 30 days.
• Platform Training License: The platform holds an anonymized, royalty-free, perpetual license to use derived geometric graphs, spatial topologies, and accuracy benchmarks internally to evaluate and train machine learning models.

6. Payment Terms & Deliverables

Uploading, converting and viewing a point cloud are free. An automated AI floor plan is billed once per scan at the price shown when you upload; by choosing it you authorize us to save your payment method and to charge it only when the plan is delivered to your account. If the plan cannot be delivered, nothing is charged. Delivered files may be re-downloaded without further charge. Models you draw yourself in the editor can be downloaded free of charge on one project per account (the first project you download them from); downloads on other projects require the Editor Plan, a monthly subscription that can be canceled at any time and does not include AI floor plans. Optional subscriptions are billed monthly and may be canceled at any time.

All payments are processed securely via third-party payment processors (such as Stripe). Fees are due prior to deliverable download or release, and are non-refundable once digital files have been generated, except where required by law. We reserve the right to update pricing or service tiers at any time.

7. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues beyond our control.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by ScanToBIM-CAD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Limitation of Liability

In no event shall ScanToBIM-CAD be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
